Citizen Activism against Felony Murder Resulting from Fraud that Led to
the Iraq War

Following the first indictments from
the first grand jury considering the CIA Leak probe under Patrick
Fitzgerald, many people cynically believe that Bush will pardon any of his
people who are convicted. "Why even bother anyway?" is a common question.
They saw Clinton pardon arch-criminal Marc Rich at the end of his term and
many remember Bush I pardoning those convicted of Iran-Contra offenses
such as Oliver North, John Poindexter, Caspar Weinberger, Eliot Abrams,
and Ollie North.
Worse still, is the suspicion that
I. Lewis "Scooter" Libby has not been charged with significant crimes,
merely obstruction of justice, perjury and false statements to a federal
officer. Kurt
Nimmo expressed the frustration well:
Imagine if a criminal broke into your house and made off
with your television, stereo, camera, and the gold coins you hid under the
mattress. Imagine the cops caught him speeding away. But instead of
arresting him for stealing your goods, they simply issued him a ticket for
speeding.
In essence, the above scenario is what happened to I.
I.
Lewis "Scooter" Libby.
Scooter was busted for telling lies to the FBI and a grand
jury and now has the distinction of being the first White House official
in 130 years to be indicted while in office.
But he is guilty of much larger crimes.
Scooter and Paul Wolfowitz are the devious criminal minds
behind the Bush gangster doctrine currently responsible for killing around
100,000 Iraqis. Scooter and Wolfowitz devised the Defense Policy Guidance
document for Dick Cheney back in 1992. It is now more or less the Bush
playbook for "pre-emptive force to prevent countries from developing
weapons of mass destruction"; in other words invading Muslim countries
that do not have weapons of mass destruction. It was also used as a
blueprint when a clique of neocons cobbled together the criminal
organization Project for a New American Century. Scooter's lies were
instrumental in the invasion of Iraq. for instance, the fairy tale one of
Saddam's intelligence agents met with supposed nine eleven "ring leader";
Mohamed Atta. Scooter was so insistent this lie be included in Colin
Powell's dog and pony show at the United Nations he called him late at
night in the eleventh hour and harangued him.
All this and so much more. Yet, there are TWO ways
to void presidential pardons.
Citizenspook has written,

to a fair reading of the Constitution, criminal court indictments,
convictions and sentences may not be pardoned when they flow from
"Cases of
Impeachment" where the Senate had voted to convict.
In order to avoid a double jeopardy defense, the Impeachment
process should be completed prior to criminal trial prosecution
and conviction. However, indictments alone do not trigger double
jeopardy defenses.
We can ensure that the House of Representatives
impeaches the traitors and that the Senate convicts them BEFORE their
trial in a criminal court. Unfortunately, the highly partisan GOP holds a
stranglehold on the entire legislative branch and few Democrats have shown
the interest in holding them to the law. The Supreme Court has been filled
with right-wing ideologues who could be expected to lean toward protecting
the President and his men, especially with the recent appointment of John
Roberts as Chief Justice and an empty seat waiting to be filled by Bush.
The
second way to circumvent presidential pardon is to indict, try,
and convict the neoconservative traitors IN STATE COURTS for FELONY
MURDER. Their fraudulence has been well-documented by the Downing Street
Documents, the AIPAC investigation by Patrick McNulty, US Attorney for
Northern Virginia, and the Fitzgerald investigation as a de facto Special
Counsel. This fraud is a felony. Any death that occurs as a direct result
of the commission of a felony can be prosecuted in every STATE COURT.
Unmentioned and unrecognized by many commentators is
the number of American men and women who have died in this fraudulent war
because of the lies and disinformation used by the Bush Administration.
The 2000 ++ US troops from all 50 states have been murdered by this
illegal war begun after the commission of felony fraud. That means that
there are potentially 50 venues that are NOT subject to presidential
pardon, and there are over 2,000 potential cases which can be tried.
The laws cited above make it clear that both the
"creation" and "use" of these
documents was a felony.
The "cover up" of the documents' fraudulent nature was also a felony.
Fraudulent statements about the veracity of the documents would also
be a felony, i.e. Bush relying on them in his State of the Union
address (the famous 16 words); and let's not forget Powell's reliance
upon them at the UN as well as Condi's mushroom cloud speech.
If proved that government officials knew the documents
were fraudulent then their criminal actions relating to such knowledge
must be prosecuted.

jurisdiction of the executive, legislative, or judicial branch of
the Government of the United States, knowingly and willfully- (1)
falsifies, conceals, or covers up by any trick, scheme, or device a
material fact; (2) makes any materially false, fictitious, or
fraudulent statement or representation; or (3) makes or uses any
false writing or document knowing the same to contain any materially
false, fictitious, or fraudulent statement or entry; shall be fined
under this title or imprisoned not more than 5 years, or both."

"If two or
more persons conspire either to commit any offense against the
United States, or to defraud the United States, or any agency
thereof in any manner or for any purpose, and one or more of such
persons do any act to effect the object of the conspiracy, each
shall be fined under this title or imprisoned not more than five
years, or both."

And therein lies the opportunity for justice
unsullied by insulting pardons by Bush. Any felonies that have resulted in
the death of a State Citizen, can and must be prosecuted by the State
Attorneys General under Felony Murder.
Another possible effect could be strengthening
Patrick Fitzgerald's hand in his Federal prosecution: if indicted felons
know that they cannot depend on the President to bail them out of a
conviction in State Court, they might be more prepared to plea bargain to
testify against their co-conspirators. Putting the pressure on from State
Courts means that criminals like Libby can't just sit back and expect to
be out of the woods with a pardon when there are dozens of groups out in
the woods working toward justice for their sons and daughters by
convicting their murderers locally. It puts another spin on "think
globally, act locally."
Still another by-product of 50 State prosecutions
for Felony Murder is the re-establishment of the Constitutional principle
of States' Rights. The Federal Government has been violating this OTHER
balance of power strategy conceived by the Founding Fathers to prevent
tyranny. When the several States united take it upon themselves to enforce
the law, they are taking back a power that has largely been conceded to
the Federal Government.
To see justice done without the prospect of a
Presidential pardon, to ensure the proper attitude of the guilty, and to
reassert the right of the people to participate in governance, we need to
create:
THE PERFECT STORM
We need a perfect storm of citizen
outrage directed into action, preferably action that has a chance to
facilitate change to return our freedom and right to participate in our
governance. Now is the time for that as the news pages fill with
revelations of wrong-doing and treason by the Bush Administration. The
polls (if you can ever believe a poll.) show the lowest ever approval
rating of Bush and his policies, approaching 28% in some instances. More
Americans come home in body bags and more Iraq War vets are speaking out
against the war. There is a storm rising and it needs a focus and tools to
allow adequate and effective expression. I think Felony Murder
prosecutions in State Courts can do that.
I think we need to start building at
the grass roots. Look at how Cindy Sheehan's protest took off. She
galvanized the anger and frustration of millions. We can do much the same
with the help of her and others.
We can be building this while Fitzgerald and McNulty are investigating.
Hopefully we can have this well underway before trials begin.
Once the grassroots understands what the issues are and what the process
is, that's when we take it to the state government. Then a refusal or
rejection would be understood by the people rather than thinking we're
just a bunch of kooks and troublemakers.
We need to gather our thoughts and resources, lay a foundation, invite
allies and more ideas and resources before we go to the state. We need to
be in op-eds, letters to the editor, and comments to blogs. We would
present the ideas to the blogosphere so that they can give us a push.
This can start in one or more states
depending upon who can take the initiative and who can muster the needed
team and support.
1. This team should examine their state
law to determine if their statutes provide for Felony Murder and on what
basis, proximal cause or agency.
2. Next is coalition building with existing organizations or interest
groups. Getting a list of the troops from that state who had died might
identify the cities or regions from which they came. Their families,
communities, local organizations could be excellent allies. Some peace
groups are not shills and could be of some use. (This would provide a very
practical test to find out which ones are fake and which are functional.)
3. Creating a website for the coalition would speed communication and the
distribution of information.
4. Conference calls can be held that are inexpensive or free.
5. Leaders will be needed to handle media and press conferences to give a
public face. A face-to-face meeting at a central location or several
locations around a large state would provide the means to really know the
people you are working with and the level of trust that can be given them.
6. With all of this in place, a public education/media project should
commence to add public support, the broader and deeper this support is,
the more likely a positive result. We might need very strong public
support to encourage district attorneys or attorneys general to act.
How much information will be contained
in the Fitzgerald documents is yet to be learned and undoubtedly, more
will emerge over the next few months. It might not even be necessary to
bring the work of this statewide group to the court. The threat of a
citizen's movement to bring this to the state courts could be enough to
keep the federal cases on track and prevent pardons. But the state group
should be totally prepared to proceed if needed. It might even be wise to
actually begin the case regardless the result at the federal level.
We'll need some background and history, perhaps a
bulletin board or Yahoo group for idea input. We need ideas, contact
information for groups and individuals who might align with these tasks
and goals. We need a short name for identification and projecting our
purpose. For now I propose "Perfect Storm." Unlike those who were
manipulated to storm the Bastille, we will try to remain free of
Freemasons and Zionists. that might try to infiltrate. We will encourage
the participation of all the families and friends of those soldiers who
were killed and injured as well as those who would like to actually DO
something for peace and justice.
We need people to find the families of the fallen so we can invite them.
This has to be grass roots and spread nation-wide to have the greatest
effect. We need people who can set up mass emailings and create databases.
We need to formulate a letter/petition to State Attorneys General to
notify them of our intent to ask for Felony Murder prosecutions of
specific individuals. How local and state politicians respond to this
movement will show their fitness to retain office. Some states have recall
provisions that could be employed. In other words, we need to leave no
stone unturned to use this issue to take back our power. When this action
is completed, we can start with State Monetary Initiatives to provide an
alternative, value-backed currency owned by the people instead of the
Federal Reserve. This is the lever and fulcrum to bring about peaceful
change around an issue upon which nearly everyone can agree. The people of
a state might appreciate that they need no longer be dependent upon the
Federal Government for its strings attached funding. With this issue we
can leverage the proper balance between state and federal and in every
case the proper balance between the government and those for whom they
work.
This can be a storm that sweeps all
pestilence into the dustbins.
